📜 Terms of Service – SaaS

1. Purpose

These Terms of Service define the conditions under which the SaaS (Software as a Service) solution provided by DB Conseils et DĂ©veloppement is made available to users.

2. Acceptance

Accessing or using the service implies full and unconditional acceptance of these Terms. Users confirm having read and agreed to them before subscribing.

3. Description of the Service

The service is a web-based software platform available via a secure interface. Features, usage limits, and subscription plans are described on the official website or provided documentation.

4. Account Access

Access requires account creation. Users are solely responsible for the confidentiality of their credentials and any actions taken from their account. Misuse or fraudulent use may lead to suspension without refund.

5. Pricing & Payment

The service is billed on a subscription basis. All prices are in Euros (€). Payments are securely processed via Paddle. Access is granted upon payment confirmation.

6. Subscription & Auto-Renewal

Subscriptions automatically renew at the end of each billing period (maximum one month) unless canceled or suspended by the user from their account dashboard.

Users may choose between two options, both effective at the end of the current billing cycle:

Cancel

  1. Request — The user cancels anytime from the dashboard.

  2. End of billing cycle — Cancellation becomes effective at the end of the current month.

  3. After — Account and all associated data are permanently deleted.

Suspend

  1. Request — The user requests suspension anytime from the dashboard.

  2. End of billing cycle — Suspension becomes effective at the end of the current month.

  3. Up to 6 months — Account remains paused with data preserved. If not reactivated within this period, the account and all data are permanently deleted.

7. Changes to Subscription Plans

Users may change their subscription plan at any time. All changes take effect immediately:

  • Upgrades — Switching to a higher plan tier takes effect immediately. Any price difference is billed on a prorated basis.
  • Downgrades — Switching to a lower plan tier also takes effect immediately. A prorated refund of the unused portion of the previous plan is applied automatically.
  • Suspended accounts must be reactivated before changing plans.

8. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply once the digital service has been fully provided or accessed with the user’s explicit consent.

9. Availability & Maintenance

The service is available 24/7, except during planned maintenance or unforeseen disruptions. Downtime will be announced whenever possible.

10. Liability

The service is provided “as is”. DB Conseils et Développement cannot be held liable for any direct or indirect damage, data loss, or service interruption.

11. Data Privacy

No personal data is collected or stored. The service is designed to operate anonymously, and users retain full ownership of any data they input (if applicable).

12. Intellectual Property

All content, structure, and code related to the service remain the exclusive property of DB Conseils et DĂ©veloppement. Unauthorized reproduction is strictly prohibited.

13. Governing Law

These Terms are governed by French law. Any disputes shall fall under the jurisdiction of the courts nearest to the company’s registered office.
